Title Policy

  1. Inride Role in Title Transfer
    Inride’s responsibility is to facilitate the transfer of vehicle titles from the seller to the buyer. This service aims to ensure a transparent and equitable process for all parties involved. Any issues related to title transfers will be addressed as per the procedures outlined in this policy. If a discrepancy arises between this policy and prevailing laws at the Federal, State, or Local levels, the latter shall take precedence.
  2. Limitation of Responsibility
    While Inride aids in the title transfer process as part of the overall vehicle sale, it does not assume the position of buyer or seller. Consequently, Inride cannot be designated as either on the vehicle title. The company’s role is strictly limited to ensuring the title is transferred from the seller to the buyer. Inride’s ability to provide a title is contingent upon its receipt from the seller. Inride disclaims all warranties relating to vehicle titles and shall not be held responsible for any harm resulting from the seller’s inability to deliver the title or any related documents necessary for validating the title’s transferability.
  3. Title Processing Guidelines
    1. Title Designation Requirements
      Before a vehicle can be listed for sale on Inride, the seller must specify the relevant title status for each vehicle, as follows:
      • “Title Present” – The seller affirms that the seller possesses the title at the time of listing the vehicle and agrees to send the title to Inride immediately after the sale concludes.  Additionally, seller agrees to attach an electronic scanned copy of the title to the vehicle listing.
      • “Title Absent” – The seller affirms that the title is not in the seller’s immediate possession, and the seller must acquire the title. Inride retains the authority to impose a fee to the seller for vehicles advertised as “Title Not Present”.
    2. Title and Transfer Documentation Upon Sale
      Upon the sale of a vehicle via Inride, the seller will be provided with mailing instructions sent to the seller’s profile email address listed on the Inride platform for the purpose of sending a Valid Title and any other required documentation.
    3. Title Mailing Deadlines
      If the sale is made with a “Title Present”, the seller is required to mail the title to Inride within two (2) business days from receipt of the mailing instructions provided by Inride.
    4. Power of Attorney
      The seller is required to execute a Power of Attorney authorizing Inride to, among other functions, fill out and sign the title on the seller’s behalf.
    5. Title Corrections
      If Inride encounters title-related issues that are not correctable under the existing Power of Attorney, the title will be sent back to the seller for amendment. The seller must rectify such issues promptly, adhering to the standard processing time for the relevant jurisdiction.
    6. Timing of Payment
      Upon receipt of a Valid Title with no lien from the seller and payment from the buyer, Inride will process the payment due for the vehicle sold.
    7. Title Handover to Buyer
      Following receipt of a Valid Title from the seller and the payment from the buyer, Inride will forward the physical title to the buyer.
    8. Deadlines for Receipt of Title and Transfer Documentation
      Should Inride not receive a Valid Title from the seller within the timeframe specified above, Inride may, in its sole discretion, extend the deadline or cancel the transaction.  
    9. Non-Production of Negotiable Title
      If the seller fails to produce a valid title within thirty (30) days post-sale, and Inride has not cancelled the transaction within this period, Inride is not obligated to seek the title from the seller or to remit payment to the seller. In the event Inride cancels the transaction due to seller’s failure to send the title in a timely manner, seller is liable for fees related to the vehicle listed for sale, including but not limited to, vehicle transportation, Inride fees, and buyer fees.
  4. Responsibilities of Seller Regarding Titles
    Sellers are required to adhere to the following obligations:
    • Valid Title Requirements
      A title is considered a “Valid Title” if it satisfies the conditions listed below:
      • It originates from a U.S. state.
      • It is duly signed and unencumbered by any liens or legal claims (except as listed below), or If the title had a lien, it must include the lien release signature and the original lien release document.
      • If the title has a current lien, seller must provide loan details, including but not limited to, name and contact information of financial institution, copy of the most recent loan statement with account number and name of account holder clearly visible, and payoff amount with good-through-date listed.
      • It includes all necessary paperwork for the buyer to register the vehicle in their state.
      • The Vehicle Identification Number (VIN) is accurate.
      • The title is not branded with Fire, Hail, Flood, Junk/Scrapped, Lemon, Salvage, Rebuilt/Rebuildable, or Odometer Brands (not actual miles, broken odometer, exceeding mechanical limits, mileage discrepancy, or suspect miles).
      • The mileage on the title corresponds truthfully with the vehicle’s actual mileage.
      • The most recent owner on the title is the seller.
      • Documents requiring notarization are fully notarized.
    • Power of Attorney to Inride
      The seller provides Inride with a signed power of attorney, authorizing Inride to complete any title details necessary for the sale, including signing the title on the seller’s behalf.
    • Title Reassignment
      The title must be directly reassigned to the buyer by the seller. Inride is not the buyer and must not be listed on the title. Any such titles will be returned for correction.
    • Title Delivery Timelines
      • For “Title Present” sales, the title delivery deadline is seven (7) calendar days from the sale date.
      • For “Title Absent” sales, the title delivery deadline is thirty (30) calendar days from the sale date.
    • Odometer Validity
      The vehicle and its title must feature a valid odometer reading, within 150 miles of the reading at the time of Inride’s Instant Offer price.
    • Remedies for Non-compliance
      Failure to meet these obligations will result in:
      • Fees charged by Inride for late or non-compliant title delivery.
      • Obligations on the seller to cover transportation and costs upon transaction cancellation, including reimbursing Inride for any related expenses.
      • Buyer’s right to cancel within sixty (60) days if undisclosed title issues or odometer discrepancies beyond 150 miles are discovered.
  5. Rights and Responsibilities of the Buyer Regarding Titles
    1. In the event buyer does not receive a Valid Title within ninety (90) days after the vehicle purchase date, then buyer may cancel the purchase by giving written notice to Inride contingent upon the satisfaction of the following conditions:
      • The Valid Title has not been received by Inride by the deadline;
      • The vehicle has been paid for by the buyer;
      • The buyer currently has custody of the vehicle;
      • The vehicle’s condition has not changed significantly since its delivery to the buyer, with no repairs or alterations made post-delivery; and
      • The vehicle’s odometer reading reflects an increment of less than 300 miles since its inspection date.
    2. Upon notice of purchase cancellation from buyer and non-delivery of the title from the seller by the deadline, the buyer shall:
      • Store the vehicle safely and securely on its premises until transportation has been arranged by Inride and the vehicle has been picked up;
      • Exempt Inride from any storage fees while the vehicle remains on the buyer’s premises;
      • Forego any ownership claims or possession rights over the vehicle;
      • Facilitate vehicle collection by Inride’s transporter at a reasonable time during standard business hours; and
      • Assume responsibility for any vehicle damages or losses incurred while on buyer’s premises.
    3. The buyer may not rely solely on discrepancies found in electronic vehicle history records from third-party sources such as CARFAX, AutoCheck, or NMVTIS to issue a purchase cancellation notice or to withdraw their vehicle offer.
    4. In case of vehicle exportation outside the United States, the buyer is responsible for verifying the negotiability of the title for such purposes.
    5. Under no circumstance is the buyer to list Inride as either the seller or buyer on any state-filed documentation. For California-based buyers, this refers specifically to the completion of the wholesale form number REG 396 as opposed to the auction form number REG 398.
  6. Limitation of Liability
    1. Neither Inride nor the seller shall be held accountable for any loss, costs, damages, or other liabilities incurred from vehicle repairs or alterations carried out prior to the transfer of title to the buyer. Should the buyer decide to undertake any repairs or alterations to the vehicle while awaiting the title, the buyer will bear full responsibility for such actions and will not receive compensation for the expenses incurred, even if the sale is subsequently voided.
    2. In the event that the seller fails to provide the title within 90 days following the sale (regardless of whether the sale was conducted with the title available or not), and the buyer has not terminated the agreement and relinquished possession of the vehicle by this deadline, Inride shall bear no liability in connection to the title’s production.
    3. The buyer accepts that Inride has not undertaken any obligation to verify the authenticity of the seller’s title or to disclose any defects within said title, and provides no guarantee in regard to the title.
  7. Modifications and Amendments
    Inride reserves the right to modify this Title Policy at any given time. Amendments come into effect on the date they are published on the Inride website unless specified otherwise within the amended policy.
